Here we go again. The RIAA is suing XM Radio for creating a device that lets people record songs from the radio. When are these idiots going to learn. I remember recording songs off the radio a long time ago. Sure, it was FM and the recording was onto a magnetic tape, but is that is only a technological distinction.
Stop suing everyone and figure out how to provide a product that people want to buy. The software industry did it, you can too.
